ORDER:
At present, under rule 91(3), the Registering Authority may allot advance registration numbers within thousand advance registration numbers from the last numbers assigned in serial order (running series) on the date of application on payment of fee prescribed. According to rule 91(2) of the Tamil Nadu Motor Vehicles Rules, 1989, the Government may reserve any registration number as they consider necessary to be assigned to the vehicles of the Government or of any person. According to the proviso, to sub-rule (3) of rule 91 of the Tamil Nadu Motor Vehicles Rules, 1989, the Members of the Tamil Nadu Legislative Assembly shall be exempted from payment of fee prescribed for allotment of advance numbers by this Government or the Registering Authority for registration of vehicles in their names. In order to clarify the registration of vehicles with fee exemption for allotment of advance registration numbers by the member of Tamil Nadu Legislative Assembly, the Government have proposed that exemption from payment of fee for allotment of fancy/advance registration number for the motor vehicles purchased in the name of the M.L.A. may be given only for one time during the course of the Assembly tenure either for allotment of fancy/advance registration numbers from Government or from the Registering Authority (R.T.O.) concerned. Accordingly, in case, the M.L.A. sells the vehicle, for which he had availed the exemption previously during the same present term, he would not be eligible for another exemption for the fee of advance registration number for the new vehicle during the currency of the same assembly. The Government have therefore decided to amend the Tamil Nadu Motor Vehicles Rules, 1989.
2. Accordingly, the following Notification will be published in the Tamil Nadu Government Gazette Extra- ordinary, dated 20th July 2007.
The following draft of amendment to the Tamil Nadu Motor Vehicles Rules, 1989, which it is proposed to make in exercise of the powers conferred by section 65 of the Motor Vehicles Act, 1988 (Central Act 59 of 1988),is hereby published for the information of all persons likely to be affected thereby as required by sub-section (1) of section 212 of the said Act.
2. Notice is hereby given that the draft amendment will be taken into consideration on or after the expiry of fifteen days from the date of publication of the Notification in the Tamil Nadu Government Gazette and that any objection or suggestion, which may be received from any person with respect thereto before the expiry of the aforesaid period will be considered by the Government of Tamil Nadu.
3. Objections or suggestions, if any, should be addressed in duplicate to the Secretary to Government, Home (Transport-VI) Department, Secretariat, Chennai - 600 009.
DRAFT AMENDMENT.
In the said Rules, in rule 91, for the proviso to sub rule (3), the following proviso shall be substituted, namely :-
"Provided that Members of the Tamil Nadu Legislative Assembly shall be exempted from payment of fee prescribed for allotment of advance numbers by the Government or the Registering Authority for registration of vehicles in their names for one time only during the period of their tenure as Member of the Legislative Assembly.".
